Our website provides information about our RV park, including amenities, rates, availability, location details, park rules, and contact information. Our website also allows you to make reservations through our reservation system, Newbook.

While we strive to keep website content accurate and current, we do not guarantee that all information—including rates, availability, site descriptions, photos, or amenity details—is complete, accurate, or up to date at all times. Actual park conditions, rates, and availability are subject to change without notice.

3. Reservations & Payments

Reservations made through our website are processed by Newbook. By making a reservation, you agree to:

  • Provide accurate and complete information during the booking process
  • Pay all charges associated with your reservation, including applicable fees and taxes
  • Abide by the cancellation and refund policy presented during the reservation process
  • Comply with all park rules and regulations provided at check-in

You must be at least 18 years of age to make a reservation. We reserve the right to cancel any reservation that we believe was made fraudulently or in violation of these terms.

Rates displayed on our website are subject to change and may not reflect real-time pricing. The rate confirmed at the time of your completed reservation is the rate that applies to your stay.

4. User Conduct

When using our website, you agree not to:

  • Use the website for any unlawful purpose or in violation of any applicable local, state, or federal law
  • Attempt to gain unauthorized access to any part of the website, its servers, or any connected systems
  • Use automated tools, bots, scrapers, or similar technologies to access or collect data from our website without our written permission

Our RV parks provide guest WiFi as a complimentary amenity. By connecting to our WiFi network, you agree to the following:

  • The WiFi network is provided “as is” without any guarantee of speed, availability, or uninterrupted service.
  • You will not use the WiFi network for any illegal activity, including but not limited to: downloading or distributing copyrighted material without authorization, accessing or distributing illegal content, engaging in hacking or unauthorized access to other systems, or any activity that violates applicable law.
  • You will not use excessive bandwidth in a manner that degrades the experience for other guests.
  • We reserve the right to monitor network activity and to suspend or terminate your WiFi access at any time, without notice, for any violation of these terms or at the request of our internet service provider.
  • We are not responsible for any data transmitted over our WiFi network. You are responsible for the security of your own devices and data. We strongly recommend using a VPN for sensitive activities.
  • We are not liable for any damages, losses, or legal consequences resulting from your use of our WiFi network.

7. Intellectual Property

All content on our website—including text, photographs, graphics, logos, icons, page layouts, and software—is the property of the respective park LLC or its licensors and is protected by United States copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from our website without our prior written consent, except for personal, non-commercial use such as printing directions or park information for your own trip planning.

8. Third-Party Links & Services

Our website may contain links to third-party websites and services, including social media platforms, mapping services, review sites, and our reservation platform (Newbook). These third-party services have their own terms of use and privacy policies, and we are not responsible for their content, practices, or availability.

9. Disclaimer of Warranties

OUR WEBSITE AND ALL CONTENT, INFORMATION, AND SERVICES PROVIDED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our website will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that the information on our website—including rates, availability, amenity descriptions, or photographs—is accurate, complete, or current.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Smoky Hill RV Land LLC, ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR WEBSITE, INCLUDING BUT NOT LIMITED TO:

  • Errors or inaccuracies in website content, rates, or availability information
  • Unauthorized access to or alteration of your data or transmissions
  • Any interruption or cessation of service
  • Any damages resulting from your use of our guest WiFi network

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF OUR WEBSITE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless Smoky Hill RV Land LLC, its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney’s fees) arising out of or related to your use of our website, your violation of these Terms of Use, or your violation of any rights of any third party.

12. Governing Law & Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms of Use or your use of our website shall be resolved exclusively in the state or federal courts located in Sedgwick County, Kansas. You consent to the personal jurisdiction and venue of such courts.

These Terms of Use, together with our Privacy Policy and any terms presented during the reservation process, constitute the entire agreement between you and Smoky Hill RV Land LLC regarding your use of our website. In the event of a conflict between these Terms of Use and the terms presented during the reservation process, the reservation-specific terms shall control with respect to your reservation.

16. SMS Terms & Text Messaging

By checking the SMS consent box on our website, I/We Agree to Receive Marketing SMS and Acknowledge that I/We may receive SMS prior/during/after the stay with Smoky Hill RV.

Smoky Hill RV Land LLC will not share or sell subscriber information with third parties for their direct marketing purposes. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
